PUPPY CONTRACT
An Agreement between Amy Monesmith (Breeder) and the Buyer:
Breeder agrees to sell to Buyer, a Labrador Retriever, referred to as Puppy, for $____.__ plus any shipping/transportation expenses include the airfare, crate, and Veterinarian's Health Certificate. A deposit of $___.__ has been received to reserve Puppy. (Deposit will be refunded if no Puppies are available.) Please make all payments by Certified Cashiers Check or Money Order paid to the order of: "Amy Monesmith". In the event that Puppy is to be shipped, payment in full must be made before shipping date. In the event of a returned check, the Buyer agrees to pay any and all bank fees associated with that returned check. Any shipping costs are to be paid by the Purchaser.
The decision to introduce a new Puppy into your home is an important step for you and your family. While the benefits of pet ownership are many, these are balanced by new responsibilities that must be assumed by each family member. We recognize that even after careful consideration, unforeseen circumstances may arise that prevent you from fulfilling these obligations.
If, for whatever reason, the Buyer cannot or does not wish to maintain custody of this Puppy, the Buyer will contact Black Powder Retrievers prior to selling the Puppy or placing the Puppy in another home to discuss placement arrangements. Under no circumstances will the Puppy be placed in a shelter. If the Puppy is found in an ASPCA shelter, Humane Society, rescue program or the like, the Buyer agrees that all rights of ownership reverts to the Breeder and thereby Breeder becomes the legal owner of the Puppy with all rights reserved and entitled to. If the buyer asks Black Powder Retrievers to take a Puppy back, Black Powder Retrievers will take the Puppy back with no compensation due to the Buyer. No compensation will be made to the Buyer in any case with the exception of those covered by Black Powder Retriever's Puppy Guarantee.
Breeder warrants that the Puppy is a healthy, sound, quality Puppy that is current on all vaccinations. Breeder has provided this Puppy with the best possible health care, grooming, and socialization, so s/he is off to a great start as a family pet and hunting companion.
Responsibilities of the Buyer
The Buyer agrees to provide the highest quality of care of Puppy in regards, including quality food, water, shelter from heat or cold; active companionship, appropriate exercise, socialization and professional veterinary care whenever necessary. Appropriate professional veterinary care includes, but is not limited to, annual exams, regular parasite checks and worming if necessary, vaccinations as recommended by local protocol, and regular heart worm preventative.
Buyer agrees to maintain preventive care of Puppy in regards to Hip Dysplasia and other skeletal diseases, such as proper nutrition (including avoiding excessive nutrition), proper exercise and preventing stress injuries.
The Buyer shall provide the Puppy with humane care and maintain it in accordance with all current and future state, county and municipal laws where Buyer resides.
By signing below, the Buyer signifies they have been instructed by the Breeder that socialization is extremely important in the proper rearing of a Labrador Retriever Puppy in order for it to become a stable adult dog. Buyer makes absolute promise that this Puppy shall receive socialization with people and other dogs. Buyer agrees to provide the Breeder with reports on the Puppy made by telephone, e-mail or letter.
Registration (The Buyer agrees to register the Puppy with the American Kennel Club)
This Puppy is being sold with _________ Registration Rights. Limited Registration is applied to ALL of our pet quality Puppies/Litters (see enclosed information on Limited Registration). The Buyer has the option of having the Full Registration restored once this guarantee is met in full, and Buyer has attained a AKC/CKC/UKC/NARHRA hunt test/working/obedience title on said Puppy.
The Buyer must use our Kennel Name Black Powder in the Puppy's AKC/UKC registered name (i.e. Black Powder's Takealine Echo, Black Powder Ruger, etc.).
In the interest in protecting the Labrador Retriever Breed it is agreed that the below sold Puppy will only be bred after each of the following conditions has been met:
- Puppy reaches minimum two (2) years of age;
- Has been x-rayed for hip dysplasia by a licensed veterinarian with film sent to OFA or Penn-Hip and has been certified clear of hip dysplasia
- CERF rating of Clear to ensure the animal is free of inherited eye defects.
In the event the Buyer chooses to breed the Puppy, the Buyer agrees that this Puppy will only be breed to Labrador Retrievers that:
- Are AKC or UKC registered.
- Have been certified free of hereditary hip dysplasia or hereditary eye disease and of good temperament.
If the Puppy is bred, accidentally or intentionally before he/she was genetically tested and certified clear all guarantees are void.
